JUNK OR GEM - TERMS OF SERVICE

1. Acceptance of Terms By downloading, installing, or using the "Junk or Gem" mobile application ("App") or accessing our website at www.junkorgem.app, you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Nature of the Service (The "No Guarantee" Clause) Junk or Gem is a data aggregation and estimation tool designed to assist resellers.

Estimations Only: All profit calculations, "Gem" verdicts, and market values are estimates based on active and sold listing data. They are not guarantees of future sale prices.

No Financial Advice: The App does not constitute financial, investment, or legal advice. You assume full responsibility for all purchasing and selling decisions. We are not responsible for inventory that does not sell or sells for less than estimated.

3. Subscriptions and Billing

Pro Access: Junk or Gem offers a "Pro" subscription ($5.99/month or $49.99/year) that unlocks unlimited scans and bulk features.

Auto-Renewal: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.

Cancellations: You can manage and cancel your subscriptions in your device Account Settings. We cannot cancel subscriptions or issue refunds directly, as transactions are processed by Apple/Google.

4. Data Accuracy and Third-Party Services

eBay Data: This App uses the eBay API to fetch data but is not endorsed by, affiliated with, or sponsored by eBay Inc.

Accuracy: We strive for accuracy, but we cannot guarantee the uptime, speed, or complete accuracy of data provided by third-party APIs (like eBay). If eBay's servers go down, the App may function with limited capability.

5. Limitation of Liability (The Shield) To the fullest extent permitted by law, Anthony David Neely shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, inventory costs, or data usage. In no event shall our liability exceed the amount paid by you for the App in the last six (6) months.

6. User Conduct You agree not to:

Reverse engineer, decompile, or attempt to extract the source code of the App.

Use the App to scan stolen goods or for any illegal activity.

Share your Pro account login with multiple users (account sharing).

7. Governing Law These Terms shall be governed by the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
